General Terms of Use

Last updated: 14 October 2026

These Terms apply to anyone using Fotia, whichever module they use. Each module also has its own Specific Terms, which add to these Terms and, for that module, prevail in case of conflict.

1.Purpose and structure

Fotia is a software platform provided as a service (SaaS), made of independent modules that can also be used separately:

Each module is governed by these General Terms plus that module's Specific Terms. A module's Specific Terms do not apply to someone who only uses another module.

  • Gate: management of organisations, guest lists, promoters (PRs), staff, QR code invitations and the recording of entries. It is intended for organisers acting in the course of a professional or business activity.
  • Gallery: collecting, organising and sharing an event's photographs.
  • Weddings: wedding websites and collection of guests' RSVPs.

2.What Fotia is not

Fotia provides software tools and technical hosting only. In particular, Fotia:

  • does not organise events and is not a party to the relationships between organisers, organisations, PRs, staff, photographers and guests;
  • does not sell, issue or certify tickets, access titles, receipts or other tax documents;
  • does not receive, hold or transfer payments on anyone's behalf;
  • does not carry out prior editorial moderation and does not use event content and data for its own purposes.

3.Definitions

  • User: a person who creates a Fotia account.
  • Guest: anyone who accesses part of Fotia without an account, through a link, code or QR received from a User.
  • Organiser: the User who creates and manages an Event, including on behalf of an organisation.
  • Event: the entity created by an Organiser, for which one or more modules can be enabled.
  • Content: photographs, text and other material uploaded to the platform.
  • Specific Terms: the terms of a single module (Gate, Gallery, Weddings).

4.Account and access

To create an account you must be at least 18 years old and provide truthful data. Users keep their credentials safe and are responsible for what happens with their account.

Guests access without registration only the parts a User has shared with them, within the limits that User has set.

5.Permitted use

You may not use Fotia to:

  • carry out unlawful activities, or evade legal, tax or administrative obligations;
  • upload content that infringes third-party rights or applicable law;
  • access other people's data or accounts without authorisation, or circumvent security measures;
  • overload the service, decompile it or extract data from it automatically without authorisation.

6.Personal data

Fotia applies the principle of data minimisation and processes personal data in compliance with Regulation (EU) 2016/679 (GDPR). The infrastructure is configured to operate mainly within the European Union.

For Event data (listed guests, check-ins, photographs) the data controller is the Organiser; detailed roles are described in each module's Specific Terms.

Full details are in the Privacy Policy.

7.Fotia's intellectual property

Fotia's software, brand, design and documentation remain the property of the service provider. Using Fotia transfers no rights over them, beyond the personal, non-exclusive and non-transferable licence needed to use the service.

8.Limitation of liability

To the extent permitted by law, Fotia:

  • does not guarantee that the service will be completely free of interruptions or errors;
  • is not liable for data loss caused by events not directly attributable to the platform;
  • is not liable for misuse of the service by Users and Guests, nor for the truthfulness of the consents they declare;
  • is not a party to the contractual and financial relationships between Organisers, organisations, PRs, staff, photographers and guests.

The service is provided "as is". Liability for wilful misconduct or gross negligence and, towards consumers, the mandatory rights under the Italian Consumer Code remain unaffected.

9.Term and termination

Users can stop using the service and delete their account at any time.

Fotia may suspend or close accounts, organisations or events in case of breach of these Terms or of the Specific Terms, unlawful use, or following well-founded reports handled under the Digital Services Act.

On termination, Events and associated data are deleted within the times set out in the Privacy Policy.

10.Changes

Fotia may update these Terms and the Specific Terms for technical or legal reasons or as the service evolves. Substantial changes are announced on the website or in the account at least 15 days in advance, except those required by law. If a change concerns specifically approved clauses, Fotia asks for a new approval before the User continues to use the module concerned.

11.Governing law and jurisdiction

These Terms are governed by Italian law.

If the User is a consumer, the courts of their place of residence or domicile have jurisdiction. In all other cases, the courts of the place where the service provider is established have exclusive jurisdiction.

Fotia's documents are drafted in Italian; translations are provided for convenience and, in case of discrepancies, the Italian version prevails.
